BAGUIO CITY – The Supreme Court (SC) en banc on Tuesday ruled with finality on the dismissal of Cadet Jeff Aldrin Cudia from the Philippine Military Academy (PMA).
In a press conference, SC Public Information Office (PIO) Chief and Spokesman Atty. Theodore O. Te, said that “the Court has DENIED petitioner Cudia’s Motion for Reconsideration as well as petitioner-intervenor’s Motion for Reconsideration with Motion to Submit Case for Oral Argument.”
”The Court had previously ruled in its February 24, 2015 against petitioner Cudia, upholding the action of the Philippine Military Academy in dismissing petitioner from the Philippine Military Academy,” Te added.
However, the prayer of Cudia seeking the release of his academic credentials in order to pursue another career was not included in the decision.
In its earlier decision, the SC said that the PMA did not commit any violation on the “right to due process” of Cudia when it implemented on him the “Rules on Discipline and Honor Code” of PMA.
It added that Cudia was also afforded sufficient time to present his defense and present witnesses and evidence.
The SC also recognized the “academic freedom” of PMA pursuant to the earlier decision of the SC pertaining to the power of the academic institutions to discipline their students.
