Draft law approved to determine experts’ qualifications, role

DOHA: The Cabinet yesterday approved a draft law to determine the qualifications and role of experts, whose services are frequently required by the courts, ministries and government institutions for opinion on issues, including litigations and disputes.
The experts are from the fields, including legal and medical practices, engineering, finance and banking and real estate, among others.
The proposed law will also define the job of the experts for specific purposes and possibly how much they would need to be paid.
The experts will need to register at the Ministry of Justice once the draft law has been approved and implemented, QNA reported yesterday. The ministry will be authorised to set up a committee to supervise the work of the experts, their registration and look into complaints filed by people against them.
Lawyer Mohamed Fadhallah told this daily that such a law has been long-awaited as courts normally appoint panels of experts to decide disputes.
The courts have their list of experts and litigants have the choice of either choosing from among them or agreeing on one from outside.
Fadhallah said the work of the experts has been unorganised in the absence of a law. “One of the biggest problems facing the judicial system has been the absence of such legislation,” he said.
Lawyer Yusuf Al Zaman said the ministry would have a list of accredited experts from various fields and the work of courts and government agencies that need their services would be easier.
Experts are usually asked to file technical reports in disputes heard by courts or assessment of properties and projects in the case of government institutions.
Such reports could be expected to be more scientific and dependable now, said Al Zaman. People and institutions have been facing problems in the absence of such a law. “We welcome it heartily.”
